2007 & 2008 AGM
The 2008 ANZ AGM is nearly with us. Just a quick update on what happened during 2008.
In January following the 2007 ANZ AGM in December I followed up Charles Goode with a letter confirming what he undertook to do with a file I provided him. He failed to do what he undertook to do.
I then sent a copy of the file to the ANZ External Auditor who after prompting advised she had passed it on to the ANZ’s Internal Audit Commitee.
I twice wrote to the Chair of the ANZ Audit Committee seeking acknowledgement of receipt but he never responded.
Why are these points important? The file contained irrefutable evidence of the serial dishonesty of Peter Donald an ANZ Executive. This information had been placed before others within ANZ with no action other than for ANZ to continue their defense of my legal action which in part included elements of Donald’s dishonesty.
What was clear from my dealings with ANZ is that they never admitted any wrong. Whilst I made damning allegations as to mismanagement and dishonesty, ANZ closed ranks.
Now with the Opes Prime debacle ANZ has shown publicly just how bad its understanding and application of its Code and Conduct and related Values Statement is.
For ANZ to have responded in part to the Security Lending Review by introducing a major reform of its Code of Conduct & Ethics supported by workplace policies. an internal awareness campaign and training program highlights just how poor ANZ must have been in this area. Oh and by the way, the new Conduct and Ethics approach includes the completion of an annual Code of Conduct and Ethics Declaration.
At the 2007 ANZ AGM Charles Goode indicated he did not believe that unethical practices that I encountered were systemic in nature and that my experience was one off.
Well the introduction of a revised Code and the significant support process across all employees suggests the Chairman was wrong.
Well the 2007 ANZ AGM is over. I was extremely pleased with the 5% plus vote.
After the experience I have already commenced formulating the 2008 AGM program. I will attempt to align myself more closely with what is obviously expected of an ANZ Director - but more on that later.
It was interesting to hear the Board re-reviewed my whistleblower issues - two weeks of a QC. interviewing all the staff involved - at $8,000 a day for a QC that’s like -wow - $80,000. And for no change.
I challenged the Chairman as to why use a QC when the matter is an ethical issue, ANZ have clearly lost the plot here and are in defence mode.
I provided the Chairman a confidential file on dishonesty by ANZ Executives - oh and dishonesty is not illegal but it is against ANZ’s Employee Code of Conduct.
